By commissioning me you agree to the terms of service below.
I. GENERAL TERMS
I reserve the right to refuse commissions for any reason.
I also reserve the right to cancel commissions at any stage. Refunds will be provided according to my refund policy. Hate speech or violence will not be tolerated and will result in a forfeit of image rights and down payment.
Please provide clear, clean reference material.
All commissions are private unless additional rights for commercial use are discussed and purchased.
Please contact me prior to ordering for commercial works to discuss budget, scope, and time constraints.
II. PAYMENT
All commissions require a non-refundable 50% down payment before sketching begins.
The remaining 50% must all be paid in full before the work will be completed.
Sketch commissions must be paid in full up front.
The currency accepted is USD.
A Purchase of Commercial rights is an additional 300% of the original price.
Private commissions come with a 50% FEE.
Physical commissions require postage fees and a mailing address provided before work can begin.
III. PROCESS
Work In Progress will be provided on request for commissions above $50.
Sketch commissions will only be provided once finished (no WIP offered).
WIPs will include watermarks and may be provided at any stage if I have a question.
Time frame for completion is 6-12 weeks. I work on commissions in the order they were received, so some may have a longer time to completion from ordering than others. If there is a delay or other issues that arise I will do my best to notify you ASAP.
IV. CUSTOMER SATISFACTION
I will do everything I can to make my customers happy.
After a commission is finished, only small changes can be made. Such changes include but are not limited to small highlighting, coloring, or marking errors.
Large changes that cannot be completed after a commission is finished include but are not limited to pose, colors, and clothes. Large changes will require additional fees up to the purchase of a new commission with appropriate add ons (eg. clothes, additional characters, upgrading a sketch to flat color, etc).
If you request a WIP and do not inform me of issues before the work is completed, I will not offer alterations or refunds.
V. COPYRIGHT / USAGE POLICY
I, Xandoval Wolfe, the artist, retain the rights to any and all works produced unless rights are purchased. I am allowed to use WIP pictures on my social media unless otherwise requested/specified during the initial commission discussion, which may include additional fees.
The client is allowed to;
Use the copyrighted artwork for personal use only unless agreed otherwise.
Print the art, and claim the right of their character(s)/concept/etc but NOT the drawing itself.
Use the art to promote themselves with proper credit given to the artist.
Violating this agreement is considered a breach of contract and copyright infringement.
The following is considered Copyright infringement:
Reproducing/using artwork commercially without purchasing the rights.
Taking Credit for the creation of the artwork.
Removing any watermarks/signatures.
Altering the artwork without my, the artist´s, consent.
Using the artwork to train AI.
Converting the artwork into an NFT.
Purchasing commercial rights gives you license to use the artwork for commercial purposes (eg., T-shirts, book covers/illustrations, personal brand promotion, etc). Credit is still required for use of the artwork, even if it is altered or edited.
Using the artwork in any way that breaches this contract entitles the artist to the total of income generated directly or indirectly from the use of the licensed materials or artwork. This applies to commissioned works as well as any and all other works I, Xandoval Wolfe, have created.
VI. CANCELATION/REFUND POLICY
I have the right to cancel and refund the money for your commission at any time.
If I have provided a client with a WIP and do not hear back within 30 days, I will consider the commission cancelled. All payments provided up until that point will be considered forfeit and become non-refundable. The work will be destroyed or provided for sale to a new client.
You may request a cancelation and refund within 24 hours of the first payment. After 24 hours you forfeit the down payment.
Once I have begun work on the second phase of the artwork (lining, coloring, etc) the entire commission fee is non-refundable.
I reserve the right to refuse future service for repeated cancellations, chargebacks, or misconduct.
Chargebacks on copyright purchases will forfeit your rights to the artwork for any and all uses.
